In regards to the NMT discussion here is what is basically needed to provide NMT:
ODODD rules:
5123:2-2-01 Provider Certification (Covers basics HS Diploma or GED, age requirements, background checks, and initial trainings needed)
Follow (C) Minimum standards for providers
And Follow (C)(2) For Independent Provider or Agency Provider (review those definitions and some exceptions within rule)
Agency providers must also follow (D) Additional standards
All follow:
(F) Provides duties regarding provision of services
(G) Procedure for obtaining initial certification (H) adding addition HCBS services (I) Renewal of certification (J) & (K) as applicable
(L) Continuing certification standards (M)-(P) as applicable
5123:2-9-18 HCBS Waivers-Non-Medical Transportation under (IO, LV1, Self)
Follow (C) Provider qualifications based on provider type: Independent Provider (follows (C)(4)), Agency Provider (follows (C) (5), or you fall under Operator of commercial vehicle
All types must Follow (D) General requirements for service delivery (included in ISP, covers safety requirements of the vehicle including inspections)
Follow:
(E) if you will be providing per trip services
OR Follow (F) if you will be providing per mile services
OR Follow (G) if you are providing services via commercial vehicles
ALL must follow (H) Documentation of Services
(H) (1) for per-trip and per-mile OR (H) (2) for operators of commercial vehicles
All must follow (I) Payment standards as applicable
USDOT (US Department of Transportation) and FMCSA (Federal Motor Carrier Safety Regulations)
Key points of determination for what rules to follow depend on type of vehicle, vehicle weight, passenger capacity or materials being carried and what it is being used for or combination of these items.
Consider weight and passenger capacity:
For what we plan to provide (NMT) Remember 5123:2-9-18 what type of service are you providing?
Per Mile- must be using a non-modified vehicle with a passenger capacity of eight or fewer and if does not weight more than 10,000 pounds you follow basic vehicle registration via OBMV.
Per Trip you have two choices modified vehicle (look at passenger capacity & weight & use) or non-modified 9 or more again look at passenger capacity, weight and use to determine which rules to follow.
Now consider what it is being used for:
This will guide you to which motor carrier rules to follow-There is a difference between Direct Compensation (which makes you a commercial motor vehicle and then would follow those rules under 5123:2-9-18) or Not For Direct Compensation. Read attachment for these rules.
Then you would follow OBMV regarding license type (CDL-Vorys provided when this is needed or general license) and insurance needs based on rule or insurance carrier requirements.
