We received your agreement to the ICF proposal and are glad that we were able to come to agreement on these terms.

Your response included questions/requests for clarification.  The first attached document has responses to your questions/requests for clarification.  If any of our responses trigger additional questions, we would be more than happy to have additional discussion around those aspects.  In particular, we understand that our response to #7 is complicated, but we really want the 90 day cost reports to be a mechanism for incentivizing conversion/downsizing.

The second document is a “clean” version of the agreement.  We would appreciate seeing your draft of an amendment to incorporate these changes into HB 59. We understand that with our response coming today, you may not be able to complete a draft by the end of this week, so just let us know when you expect to have one ready to share.

We’ve also included a draft exception review rule, which implements ORC section 5124.193, for your review as well as proposed changes 5123:2-7-20 to shorten the time frame for revisions from 80 days to 45 days.  Please take some time to review and feel free to provide feedback.
