As promised, below are the DODD Work group: MUI/UI notes from today’s meeting.
Discussed all committee member feedback on peer to peer and failure to report at length.
Summary
Draft of 5123:2-17-02 reviewed:

Proposal to move Failure to report, Peer to peer, Exploitation, Rights code violation to Category B (rewording Peer to peer to be clearer for physical acts and verbal acts)
·
New proposed definition for neglect: when there is a duty to do so, failing to provide individual with medical, personal care, or supports that consequently results in serious injury, or places the individual’s health or safety
at significant risk of serious injury or harm to individual or others, or death.
(requires medical or professional treatment)
Significant risk: risk with high probability to cause physical harm

Added prone restraint (to current physical abuse definition)
·
Added AED to current medical emergency definition
·
Unapproved Behavior support category (proposal to change to UNPLANNED behavior support to remove unapproved stigma)
·
Unscheduled hospitalization (current definition to be clarified to hospital stay over 24 hours)
·
Added systems neglect: means a neglect that could not determine a PPI. Multiple variables account for the outcome and no one person is responsible.
·
NEW CATEGORY (for those issues previously that were always picked up as neglect) PROGRAM IMPLEMENTATION INCIDENT (UI means failure to carry out the duty as per the person centered plan that does not cause injury, or place the
individual’s health and safety at significant risk. These incidents may include some level of risk but do not rise to the level of reportable MUI for Neglect. Examples include, but would not be limited to, failure to provide supervision for short periods
of time with minimal risk, auto accidents without harm, medication errors with minimal risk, self-reported incidents with minimal risk. (This would not include documentation errors)

D (4) b-Removal of employee from direct contact with any individual when the employee is alleged to have been involved in ABUSE until such time the provider has reasonable determined removal is no longer necessary; (REMOVED NEGLECT
FROM THIS) still must have immediate action

Discussion on County board providing weekly status report when provider employee is off schedule; will create system for guardian and provider to be notified throughout for status
Next meeting: OCT 30th-review of changes to draft proposed at Sept meeting; discussion on timelines, roles, annual reports etc…for the rest of the draft rule.
(with hopes to wrap up rule recommendations shortly after that)
