I just wanted to relate our experience during a recent audit by the
Bureau of Workers Compensation because I found out something that I did
not know.
While everything was fine, there was one "finding". This is what it
said: "The only discrepancy that was found during the audit is that
none of the officers were reporting the minimum. Even though the
corporation is a non profit, you would still need to report at least one
officer up to the minimum for each period. The amount found was enough
to constitute a debit finding and a bill will be sent once the audit has
been processed."
I was told that the bill was for about $520.00 (for a 1-year period).
The auditor explained that we need to report at least the minimum
($10,894) each period (every 6 months) for at least one of our corporate
officers, which he said would be one of our board members. I told him
that didn't make sense, and he told me that he didn't agree, but that's
the way it is.
After he left, I found what he was talking about on BWC's website (see
attached).
I was able to go back to him and cited a couple of things from our
agency's by-laws: 1) All members of the Board of Trustees shall serve
without compensation for their services; and 2) The Executive Director
shall serve as ex-officio member of the Board and all committees. The
Executive Director is responsible for the daily operation of the
corporation and is the person to whom all Board correspondence and
business shall be directed.
He showed these things from our by-laws to his supervisor and the
supervisor determind that the Executive Director was an "officer" and
the "finding" went away.
