OPRA has met with DODD about this issue and has been given the direction that Lisa describes below. The services are distinct, so can be billed at the same time. Direct service staff do not need to clock out and then back in as the nurse is not providing H/PC. I will double check with DODD one more time and let everyone know if there are any additional pieces of information. The SSA Director and I conferenced with the Department and was told that if the ISP clearly defines what home health is doing and what waiver staff are doing and it is clearly 2 different types if service then the 2 hour rule does not apply. HH can perform nursing and waiver staff can resume H/PC without interruption in service. We are practicing this in several sites without issue.
