I was recently involved with this exact scenario in the county you are referring to Jan. The SSA Director and I conferenced with the Department and was told that if the ISP clearly defines what home health is doing and what waiver staff are doing and it is clearly 2 different types if service then the 2 hour rule does not apply. HH can perform nursing and waiver staff can resume H/PC without interruption in service.

We are practicing this in several sites without issue.
