Any background on why this change was implemented and without a comment period?

So, what if the new waiver start date is out of the same "program year"?  Say the disenrollment date was 5/1/16 and the new enrollment date was 9/1/16.  This doesn't really say what happens if it is out of the same program year.  Do they get put on the waiting list for a new waiver??  What happens?  We regularly have folks who require more than 90 days in the hospital or rehab facility, then return home.  Will local county boards be expected to pick-up the services with supported living funds until the person is re-enrolled in a waiver?

Attached is a memo from DODD which attempts to clarify the communication sent out earlier this week re: waiver eligibility and short term stays in institutional settings. Please note that after 90 days, the individual will be dis-enrolled.
