Update on Conversation with PUCO on CMVs
COMMERCIAL MOTOR VEHICLES LAW-PUCO-PATH TO EXEMPTION
Our most recent conversation with PUCO representatives yielded a more concrete
path to follow in our desire to exempt the provision of transportation from PUCO
regulation. The suggested course of action (as affirmed by PUCO Chairman Azim Haque)
is to apply to the Federal Government for a variance of the regulations. To do this we must first
make a request to and receive approval from the PUCO Commissioners.
The governing federal regulations are cited below:
49 CFR 350.345 Federal- How does a State apply for additional variances from the FMCSRs?
This approach does not guarantee success either through the PUCO or through the FEDS.
But it does start us off with what appears to be a good working relationship with PUCO staff
(in part because this option does not risk them losing federal money) and if successful offers us
a permanent solution. The documentation required looks to be extensive and we will look to
our law firm Vory’s to assist in the preparation.
As we move down this path with urgency we will also look to you, our members, to support
this effort with backup data if you would be so kind upon request. In addition we will look
for allies in the Department of Developmental Disabilities and other entities where their support
would prove helpful. We will do the same thing at the federal level as we progress.
