As you are aware, the competency based add on will become effective July 1. We have been getting questions as to whether or not this add on can be passed on to staff in the form of a bonus. We asked Vorys for
an opinion, which is attached. The short answer is Yes, a bonus structure would be legal. The longer answer however, is that these bonuses would be considered non-discretionary, therefore subject to DOL overtime rules (which in my read, may complicate calculations).
