Please see below. I have already shared the most recent (committee) draft of the residency agreement on the list serve, which I know some of you are using. DODD has informed us that they are planning to release 2 versions of the agreement – one for provider owned and one for provider controlled. I have not yet seen these versions. DODD is not planning on enforcing this until October.

DODD does not intend to begin regulatory enforcement of the new rule on June 1^st. We do anticipate adding it to our review tool update which will be effective October 1, 2016. We feel that this will allow time for the last residency agreement draft to be modified, submitted for final feedback, and disseminated to the field with some guidance on implementation. We look forward to partnering with OPRA and other stakeholders to get information related to the residency agreements out to the field.
