The HCBS - Ensuring the Suitability of Services and Service Settings (5123:2-9-02 attached) goes into effect June 1. This is the rule that requires a lease or a residency agreement in provider owned or controlled settings. See page 2 (15) for the full definition.

 

OPRA was involved in the work group that drafted this rule. In addition, VORYS drafted a Residency Agreement at the request of DODD (attached). We fully expected that the Residency Agreement would be sent out with the rule, however it was not. This agreement was vetted and modified by the work group that included OPRA, DODD, the County Board Association and Advocates. Therefore, we feel that this is an acceptable template document for you to use. Please note that APSI sent this to their legal team for a minor modification, which will state that APSI does not assume any financial liability for the individuals they serve.
