Everyone,

 

I have heard SOOOOOOOO much hype about the new Minimum Salary regulations … most of which are not true.  Every radio station, media outlet and well-intentioned person with a computer is putting stuff out there for you to help make things VERY confusing for you.  

 

For instance, I have heard many times over that these new regs do not apply to non-profits.  That is NOT true.  They do.

 

I have attached the publication from the DOL that states that non-profits are covered by these new regs.

 

However, organizations who provide Medicaid-Funded Services for individuals disabilities in residential homes and facilities with 15 or fewer beds will not be required to comply with these new regulations until March 17, 2019.

 

I am also attaching the slides for a webinar I am getting ready to record.  However, I thought these slides might help clarify things for you until I get it all recorded.  So, I am sending it to you now.

 

The regs do not have anything to do with on-call pay, recording hours, working after hours, working through lunch or travel time, to mention a few. 

 

It also does not affect the Salary Test for exempt status.  It affects the Minimum Salary Test only.

There is no congressional review process as they beat the Congressional Review Act deadline of May 23rd.  

 

Separate legislation to stop the rule probably won't fly. It is highly unlikely that the president will sign any legislation that stops the rule and Congress doesn't seem to have the votes to override a presidential veto. 

 

Our path is legislation that doesn't overturn the rule, rather gives us additional funding on a temporary basis to figure out how we're going to live with the rule in the long run.  It's all extremely touchy one and uphill.  We don't want to do anything that would jeopardize that very slight possibility.  So, we're "keeping our powder dry" and working with the administration and Congress on a viable solution for us that doesn't threaten the rule.

Not going to help recruiting into our field that is for sure.  I can appreciate the “delay of sentence” but if a professional can work for a home health agency, mental health agency, children’s agency or other social service/non-profit and receive the benefit of OT pay, why would that professional stay in the field of DD.  

 

This will turn our DSP crisis into a DSP and Management Professional crisis.
