There are no decision points at this time. We had a good discussion that left us with a better sense of the legal intricacies of this case. For the most part, the items specified in the Guardian's Exhibit 5, which was sent last week, are more of a "wish list" of issues they would like to see resolved. These items are however, not normally issues in which a court could or would intervene. They are issues for a legislative or rule making process, not of a legal proceeding. In order for these items to be considered by the court, the Guardians would need to demonstrate harm and have aggrieved parties named in the claim. The Guardians are working with their legal counsel on revisions to their issues for filing with the court. We expect to see them in the next couple of weeks. Once received, we will evaluate the claims and look to see if there is anyway OPRA can be of assistance. We also discussed the pros/cons of having the lawsuit dismissed. There was agreement that a dismissal would be welcomed, but some questioned whether or not OPRA should be the one to file for dismissal with the court. Pete is reaching out to the attorneys of the parties for further discussion. We will keep you posted on any further developments. Let me know if you have any questions. This morning, the OPRA Board sub group met with Caroline Lahrman in follow up to the conversation at Wednesday's Board meeting. It was a good discussion and provided us with some points of clarification. At this time we are not ready to make a recommendation and anticipate that this process will result in a robust conversation with the full Board. Caroline's group committed to working with us and our legal counsel on their claims, as well as to open dialogue and the sharing of information. As with most things legal, this is a complex situation with several possible outcomes and varying viewpoints. We were left with a couple of questions after the meeting today. The Guardians had numerous requests in an exhibit they have provided to the court (which I will forward to you). They are not expecting that all of these will be included in their claims, but were unsure as to the specifics in their upcoming filing. That being said, we feel we need further clarification as to the power of a judge to mandate legislation/rule making from the bench. We also need to discuss in more detail filing for dismissal of the case (pros/cons). To that end, we have scheduled a call with Vorys for next Wednesday. I will forward the filing.
