We did advocate strongly for the requirement for county boards to be required to notify families/individuals of the availability of ICF¹s. It is required that the county provide access to a county board person to tell the person about all of the ³alternative services² available - this includes ICF¹s and all other services that might meet the individual¹s needs. The language is in sections (B)(1) and (D)(4)(d): (B)(1) "Alternative services" means the various programs, services, and supports, regardless of funding source, other than home and community-based services, that exist as part of the developmental disabilities service system and other service systems. ___________________________________________________________________________ ____________________ (D)(4) When a county board places an individual's name on the waiting list for home and community-based services, the county board shall: ... (d) Provide contact information to the individual or the individual's guardian, as applicable, for a person at the county board who can provide information regarding alternative resources to address, to the extent possible, the individual's needs. They would not specifically call out ICF¹s, they said, because this is an HCBS waiver rule. We disagreed, but finally compromised to the language above. As Anita and Jeff have already mentioned, this leaves a clear path for us to pursue the requirement of this notification in statute. Now, about the notification of vacancies in group homes. This is the HCBS waiver waiting list rule, not the service planning rule. It stops short of what happens after the person is placed on a waiver. As we are doing with ICF vacancies, we may want to pursue a campaign to inform families/individuals of these vacancies. We can talk more about it at the February board meeting, if you¹d like. Thanks.
