Dear Colleagues,

In the next week or two, we will put together a comprehensive piece on
the health care tax credit since most of the regulations have now been
released.  In the meantime, here is some information you can forward to
clients who have questions about the credit.  The attachment is a great
piece that is branded by Wells Fargo.

The IRS just released the "average premium" by state, which can be found
at http://www.irs.gov/pub/irs-drop/rr-10-13.pdf.  The client must use
the lesser of their actual premium and the "average premium."  Note that
the IRS may revise these figures by certain regions within Ohio, but
this has not yet been done.

Here are a few details:

*  Eligibility for the credit starts with the client's plan year that
begins in 2010;
*  Companies with more than 25 full-time equivalents or an average
salary exceeding $50,000 are not eligible;
*  Owners and shareholders owning more than 2% in an s-corp are removed
from the calculation, along with any of their family members;
*  The employee calculation is based on full-time equivalents;
*  The credit is based on the employer's contribution only, not total
premium;
*  And for those not fluent in mathematics lingo, the numerator is the
top number of a fraction and the denominator is the bottom number of a
fraction.
