The rules attached to the email are designed to implement language that was included in the state budget passed last year to eliminate the DODD county board risk fund. County boards and the department agreed that the risk fund was not functioning as intended. This rule and a companion rule by ODJFS were filed with JCARR (Joint Committee on Agency Rule Review) late last week. DODD, in working with the county boards and other stakeholders, has developed the attached rule to respond to county requests for assistance in the event that a levy failure means that the county cannot meet its obligation to serve the required number of individuals on HCBS waivers. This rule replaces the current risk fund. The new rule sets out a specific process for boards to follow when requesting assistance, including: -extensive evaluation by DODD officials regarding efficiency of administration -use of Medicaid to support services in the county -county board's plan to resolve its financial situation -reasonableness of costs of the county board in comparison with other agencies -alternatives to assistance such as structural and operational changes to the county board After being evaluated, DODD may choose whether or not to assist the board. If assistance is granted, funding could be provided to help pay the non-federal share of Medicaid waiver costs or reduce the number of individuals required to be enrolled in waivers (ORC 5126.0512). OPRA is constantly reviewing proposed agency rules, such as this one. I am always on the lookout for assistance in evaluating the impact of rules.
