I have just one question other than all the other obvious comments we all could make, under what authority do they have the ability to do this given this service code is pursuant to a current administrative rule?

Subject: More changes to the day array rules beginning November 1st.

 

Dear Ohio Providers,

 

If your organization provides Waiver services in the day array, you have likely received the attached memo from DODD announcing a delay in implementation of the new day array rules. In summary, DODD states the new rules scheduled to begin on November 1st will be delayed pending CMS review.

 

Despite this delay, DODD is still planning to eliminate the combo code for Day Support and Vocational Habilitation on November 1st. DODD understands that the elimination of the combo code without the ability to use medical, behavioral, and community integration add-ons may have a negative effect on providers and subsequently the individuals served. DODD is currently drafting guidance on how the combo code will be eliminated while minimizing any unintended negative consequences to stakeholders.
