Attached are DODD’s proposed DRAFT rules and rates for:

Please review these proposed rules and rates. Do they allow you to meet your organization’s mission? Do they allow you to provide good lives to the people you support? Concerns and solutions
are welcome. Please send me input by early morning Tuesday, May 31st.
Below are notes on the new rules and rates:

Outcome statements have been added to each service (or will be added by June 1st)

Competitive Employment has been clearly defined. Group or enclave employment will be a billable waiver services, but will not be considered competitive employment, even if the individuals
receive minimum wage or above. This may affect providers who are supporting individuals under the age of 24 years in group or enclave employment due to WIOA.

In many cases DODD has added the ability for new staff with at least one year experience providing the service to forgo some of the training requirements. Related experienced will
also be allowed in some cases.

A data collection component has been added to the rules
·
Rates are a combination of flat rates and 15 minute units. We have verbally challenged the 15 minute unit as being overly cumbersome and not a good use of human capitol. DODD believes
15 minute units will allow individuals served to use their funding in a more person-centered manner. Fifteen minute units will also help DODD to precisely track and report to CMS the progress Ohio is making towards complying with the HCBS settings rule.

The General Requirement rules are still very rough but do include the budget limitations in appendix C
·
Rules pertaining to transportation used for community integration during day services have not been released. DODD does seem inclined to make these rules similar to HPC transportation
rules. Providers will likely have flexibility on vehicle type, as well as have the ability to bill for units of service during drive time and mileage.
